How the Grammy-Winning “Flowers” Led to Legal Woes
Endless Summer Vacation proved Miley Cyrus is worthy of her acclaim and fame in 2023, earning her six nominations at the 66th Annual Grammy Awards, including Album of the Year and Best Pop Vocal Album.
Also, she won Best Pop Solo Performance and Record of the Year for her hit song “Flowers,” helping Cyrus to enjoy a career-high.
While “Flowers” resulted in much acclaim, it led to Tempo Music Investments filing a lawsuit for copyright infringement in September 2024.
The company accused Cyrus of the “intentional copying” of Bruno Mars’ song “When I Was Your Man”, written by Philip Lawrence.
As the company acquired a share of the songwriter’s music catalog in 2020, it didn’t hesitate to seek legal action after it “recognized the striking similarities” between Mars’ song and Cyrus’ “Flowers.”
Michael Pollock and Gregory Hein, who co-wrote the song alongside Miley Cyrus, have been named in the lawsuit, as have Sony Music Publishing and the song’s distributors, Apple, Amazon, and Live Nation.
The legal document claims, “It is undeniable based on the combination and number of similarities between the two recordings that ‘Flowers’ would not exist without ‘When I Was Your Man,'” and states the Grammy-Award winning song “duplicates numerous melodic, harmonic, and lyrical elements.”
The company’s lawyer, Alex Weingarten, believes Cyrus deliberately stole from Mars’ song, stating, “A comparison of the lyrics of the two songs also suggests that the musical similarities are no coincidence.”
Tempo Music Investments is hoping the defendants listed in the lawsuit will stop reproducing, publicly performing, and distributing “Flowers” and are seeking financial damages.
Will Miley Cyrus Settle Out of Court?
Miley Cyrus and her reps have yet to comment on the lawsuit from Tempo Music Investments. However, it is common for singers facing similar legal issues to settle out of court.
For instance, Ed Sheeran settled out of court for copyright infringement cases for the songs “Photograph” and “The Rest of Our Life.”
Also, Sam Smith settled out of court with Tom Petty, as his song “Stay with Me” had similarities to Petty’s “I Won’t Back Down”.
However, Miley Cyrus could follow in Ed Sheeran’s footsteps by taking the case to court to prove her innocence, which has worked in the British singer-songwriter’s favor for multiple cases in the past.
